One of the most common questions I get is: “How much will a divorce cost?” The best answer I can give is: it depends. If you are in need of an attorney to assist you in the process, you should inquire with your attorney about their hourly rate, as well as retainer fees. Depending on the number of issues between you and spouse that need to be addressed and resolved, a divorce can cost thousands of dollars. If you and your spouse can come to an agreement on any of those issues, doing so will reduce the overall expenses you incur.
For example, if you and your spouse can reach an agreement regarding your children to address custody, support, and a schedule, then you will drastically reduce the cost you will incur, as you won’t need to litigate these issues. Even if you can’t reach a full resolution on all issues, any one that you can resolve is a win for both parties and more money that you can use to move forward with your life rather than incurring debt or litigation fees.
I strongly urge all parties to seek the help of a mediator to try and resolve as many issues between you two before seeking relief from the court if possible. And if you must file in court, then talk with your attorney about ways that you can reduce the costs you incur. For example, the discovery process is where many people can incur significant legal fees. Work with your attorney to keep those costs down by providing timely responses and organized documents so that you don’t incur expense for your attorney to organize documents that you easily could have done yourself. Do your best not to let your emotions drive you. This is an extremely emotional process, but you will incur significant legal fees if you let your emotions drive your actions instead of listening to the advice your attorney gives you. Remember that the court system is overburdened and it takes time for a case to work through the courts, so plan with your attorney and take steps to minimize your costs as much as possible.
