CSRS Retirement Benefits in Family Law Matters

Retirement Benefits in the Case of Divorce, Annulment, Legal Separation, Alimony & Child Support

If you are considering divorce, annulment, or legal separation, a comprehensive resolution may involve the disposition of or preservation of valuable assets including retirement benefits. Additionally, whether you are paying alimony or child support or seeking support and maintenance from a spouse or parent, you may have valuable rights under certain retirement plans.

What Benefits Are Outlined in the CSRS?

Under the Civil Service Retirement System (CSRS), employees and former employees of the federal government may be eligible for certain benefits which may include annuity payments, lump-sum payment of employee contributions, death benefits, and survivor benefits. Certain CSRS benefits including annuity payments and survivor benefits can be awarded to a former spouse.

Divorce, Annulment, or Legal Separation

In connection with a divorce, annulment, or legal separation, a court order acceptable for processing can be used to provide for the division of retirement benefits under certain governmental plans including Civil Service Retirement System (CSRS). A court order acceptable for processing may divide retirement benefits including employee annuities, refunds of employee contributions, and survivor annuities. In addition, under certain conditions, division of CSRS benefits can create eligibility for a former spouse to enroll for health benefits coverage under the Federal Employees Health Benefits (FEHB).

Alimony

In connection with the payment of alimony for the support and maintenance of a spouse or former spouse, in appropriate circumstances, CSRS benefits can be garnished to enforce an existing obligation.

Child Support

In connection with the payment of child support for the support or maintenance of a child, in appropriate circumstances, CSRS benefits can be garnished to enforce an existing obligation. Additionally, a judgment for physically, sexually, or emotionally abusing a child, can be collected in appropriate circumstances using CSRS benefits.
