First generation immigrants and non-English speaking employees often experience difficulty in obtaining legal representation due to language and cultural barriers. The panel will offer practical advice, tips, and considerations for representing these clients. Topics to be addressed include the following:

  • How immigration status may (or may not) affect what claims can be brought.
  • Do you want a judge or jury?
  • How immigration status may affect the response of opposing counsel and defendants.
  • How to effectively prepare clients for presenting at trial and what strategies can be used to prepare a client to testify with the assistance of a translator.
  • Cultural issues that would affect the quality of communications with clients during litigation.
  • What translator services the federal and circuit courts have to assist attorneys and attorney considerations in selecting a translator over a non-translator.
